By using Cadence CX ("the Service"), a product of Craft and Code LLC ("we," "us," or "our"), you agree to these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Description of Service

Cadence CX is a customer experience management platform that helps professionals organize, document, and optimize their CX operating models. The Service includes tools for framework documentation, meeting management, journey mapping, calendar integration, and AI-assisted content generation.

3. User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

4. User Content

You retain ownership of all content you create or upload to the Service. By using the Service, you grant us a limited license to store and process your content solely for the purpose of providing the Service to you.

5. Third-Party Services and Integrations

The Service integrates with third-party services including Google Calendar, Google OAuth authentication, and artificial intelligence providers (such as OpenAI, Anthropic, and Google Gemini).

When you use these integrations:

• Your use of third-party services is subject to the applicable third-party's terms of service and privacy policies
• We are not responsible for the actions, content, or policies of third-party services
• You authorize us to access and use data from connected third-party services as necessary to provide the Service's features
• You can disconnect third-party integrations at any time through your account settings

When you use AI-assisted features, your content may be processed by third-party AI services according to their respective terms and privacy policies. We recommend reviewing the privacy policies of these providers. You can choose not to use AI features if you prefer not to have your content processed by third-party AI services.

6. Acceptable Use

You agree not to use the Service for any unlawful purpose or in any way that could damage, disable, or impair the Service. You may not attempt to gain unauthorized access to any part of the Service or its related systems.

7. Intellectual Property

The Service, including its original content, features, and functionality, is owned by Craft and Code LLC and is protected by copyright, trademark, and other intellectual property laws.

8. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, secure, or error-free.

9. Limitation of Liability

To the fullest extent permitted by law, Craft and Code LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.

10. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of significant changes by posting a notice on the Service. Your continued use of the Service after such modifications constitutes acceptance of the updated Terms.

11. Termination

We may terminate or suspend your account immediately without warning if you violate these Terms or if your conduct is harmful to other users, us, or third parties. Upon termination, your right to use the Service will immediately cease.

12. Pricing and Payment

Our pricing and payment terms are as follows:

• Subscription fees are billed monthly, quarterly, or annually (see current pricing page)
• 7-day free trial with no charge if cancelled during the trial period
• Payments are processed securely through our payment provider(s)
• You can cancel your subscription anytime from your account settings
• If you cancel, your access continues through the end of your paid billing period
• Refunds are governed by the Refund Policy below
• We reserve the right to change pricing with 30 days advance notice

13. Refund Policy

We want you to feel good about Cadence CX. If you're not satisfied, please reach out and we'll do our best to make it right.

Free trial: Cancel within the 7-day trial to avoid any charges.

Monthly plans: Refunds are generally not provided for partial billing periods, but if you contact us within 7 days of a renewal charge, we may offer a full or partial refund at our discretion.

Quarterly plans: If you cancel within 14 days of purchase or renewal, we will provide a prorated refund for unused months in the quarter, minus any discounts or credits applied. After 14 days, quarterly subscriptions are non-refundable, but you will retain access through the end of your paid term.

Annual plans: If you cancel within 30 days of purchase or renewal, we will provide a prorated refund for unused months, minus any discounts or credits applied. After 30 days, annual subscriptions are non-refundable, but you will retain access through the end of your paid term.

Abuse prevention: We may deny refunds in cases of suspected fraud, abuse, or repeated refund requests.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, United States, without regard to its conflict of law principles.

15. Dispute Resolution

Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in Texas, United States. You may bring claims in small claims court if they qualify. Both parties waive the right to a jury trial or to participate in a class action.

16. Copyright and DMCA

We respect intellectual property rights. If you believe that content on our Service infringes your copyright, please contact us at support@cadencecx.com with: (1) identification of the copyrighted work, (2) identification of the infringing material, (3) your contact information, (4) a statement of good faith belief, and (5) a statement of accuracy under penalty of perjury.

17. Export Controls

You agree to comply with all applicable export and import laws and regulations. You may not use the Service if you are located in a country embargoed by the United States or if you are on any U.S. government list of prohibited or restricted parties.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Craft and Code LLC regarding the Service and supersede any prior agreements.
